Effective Date: August 26, 2026. Homes Away From Home is operated by Thomas Housing LLC. These Terms of Service and the policies incorporated into them govern your use of Homes Away From Home, including awayhomestay.com and related services, features, communications, and payment functionality. By creating an account, clicking an agreement checkbox, publishing a listing, submitting a rental request, making or receiving a payment through the Platform, or otherwise using the Platform after these Terms are presented to you, you agree to these Terms and applicable incorporated policies. Nothing in these Terms waives rights or remedies that cannot lawfully be waived.
Terms of Service
1. Homes Away From Home Is a Technology Marketplace
Homes Away From Home ("Homes Away From Home," the "Platform," "we," "us," or "our") is an online technology marketplace that enables independent property owners and prospective renters to discover listings, communicate, submit rental requests, use identity-verification tools, process eligible payments through third-party payment providers, maintain transaction records, and use other rental-related technology.
Homes Away From Home supports furnished and unfurnished rental listings and may be used for short-, mid-, or longer-term rental arrangements where permitted by applicable law.
The actual rental relationship is between the applicable property owner and renter.
Unless Homes Away From Home expressly enters a separate written agreement stating otherwise, Homes Away From Home is not:
- the property owner;
- landlord;
- tenant;
- property manager;
- real-estate broker;
- real-estate salesperson;
- leasing agent;
- employer;
- staffing agency;
- university;
- healthcare facility;
- insurer;
- guarantor;
- trustee;
- escrow company;
- bank;
- financial institution;
- attorney;
- tax adviser;
- financial adviser;
Homes Away From Home does not own, possess, maintain, repair, operate, or control third-party properties merely because they are listed on the Platform.
Homes Away From Home is not a party to an independent lease or rental agreement solely because the parties met, communicated, verified identity, maintained records, or processed payments using Platform technology.
The Platform's actual activities, and not merely the terminology used in these Terms, determine the legal obligations that may apply to Homes Away From Home.
2. Independent Rental Relationship
Property owners independently determine, subject to applicable law:
- whether to offer a property;
- rental availability;
- rental rates;
- security-deposit requirements;
- property rules;
- lawful eligibility criteria;
- cancellation terms;
- lease terms;
- utility arrangements;
- pet policies;
- lawful occupancy limits;
- whether to accept or decline a prospective renter.
Renters independently determine whether to request or enter into a rental arrangement.
Any lease or rental agreement is a separate agreement between the property owner and renter.
Homes Away From Home's Terms govern use of the Platform. They do not replace the parties' lease or rental agreement.
If a conflict exists between a private rental agreement and applicable law, applicable law controls to the extent required.
3. No Property-Management Relationship
Homes Away From Home provides technology and does not assume the property owner's legal responsibilities as a housing provider.
Homes Away From Home does not:
- maintain or repair listed properties;
- negotiate lease provisions as an agent for either party;
- determine legally required property disclosures;
- perform landlord inspections;
- determine lawful security-deposit deductions;
- make eviction decisions;
- determine whether a lease has been breached;
- decide whether claimed property damage occurred;
- adjudicate landlord-renter disputes; or
- guarantee compliance with landlord-tenant law.
Platform features that help users communicate, document transactions, send reminders, process payments, or organize rental-related information are technological tools and do not create a property-management, brokerage, fiduciary, or agency relationship.
4. Property Owner Eligibility and Representations
By publishing or maintaining a listing, the property owner represents and warrants that the owner:
- owns the property or otherwise has lawful authority to advertise and rent it;
- has authority to enter into the offered rental arrangement;
- has obtained any required consent from co-owners, landlords, lenders, associations, or other parties where legally necessary;
- will obtain and maintain licenses, permits, registrations, and approvals required for the property and rental term;
- will comply with applicable landlord-tenant laws;
- will comply with federal, state, and local Fair Housing and nondiscrimination laws;
- will comply with zoning, occupancy, building, fire, health, safety, and habitability requirements;
- will comply with applicable security-deposit laws;
- will provide legally required notices and disclosures;
- will accurately disclose rent, mandatory charges, security deposits, utilities, and other amounts;
- will maintain appropriate property or landlord insurance;
- will comply with applicable HOA, condominium, lease, mortgage, or similar restrictions;
- will accurately describe the property, amenities, location, availability, and material conditions;
- has the legal right to use photographs, descriptions, videos, and other content submitted with the listing; and
- will comply with applicable tax obligations.
Homes Away From Home may require an affirmative owner acknowledgment before a listing is published.
5. Renter Responsibilities
Renters are responsible for:
- providing truthful account and rental-request information;
- reviewing property information before entering a rental agreement;
- reviewing the applicable lease or rental agreement;
- understanding amounts due;
- complying with lawful rental obligations and property rules;
- making required payments;
- caring for property they occupy;
- determining whether a property is appropriate for their needs;
- obtaining appropriate renter's or other insurance where desired or required; and
- complying with applicable law.
Homes Away From Home does not guarantee that a particular listing or rental arrangement will meet a renter's personal, financial, professional, educational, accessibility, or housing needs.
6. Listing Information
Property listing information is primarily submitted by property owners.
Homes Away From Home does not independently guarantee:
- ownership of the property;
- authority to rent;
- listing accuracy;
- square footage;
- property condition;
- habitability;
- amenities;
- furnishings;
- utilities;
- internet availability;
- neighborhood conditions;
- parking availability;
- accessibility features;
- rental availability;
- compliance with local rental laws.
Homes Away From Home may remove, restrict, or request correction of listings that appear fraudulent, unlawful, misleading, discriminatory, unsafe, duplicative, or inconsistent with Platform rules.
Such Platform enforcement does not constitute an inspection, certification, guarantee, or approval of other listings.
7. Identity Verification
Homes Away From Home currently uses Stripe Identity or related Stripe technology for certain identity-verification functions.
Where applicable, users may be required to submit information directly through Stripe's verification process.
The Platform may display an "ID Verified" indicator after the applicable verification requirements have been successfully completed.
Identity verification means only that the applicable identity-verification process was successfully completed.
Identity verification is not:
- a criminal background check;
- credit check;
- eviction-history check;
- rental-history check;
- employment verification;
- income verification;
- sex-offender-registry search;
- property-title search;
- character assessment;
- safety assessment;
- financial qualification;
- guarantee against fraud.
An ID Verified user is not guaranteed to be safe, trustworthy, honest, financially responsible, or suitable for a particular rental transaction.
Users must continue to exercise independent judgment.
8. Verification Requirements for Payments
Homes Away From Home may require property owners, renters, or both to complete identity or payment-account verification before certain payment features become available.
Verification requirements are intended to support identity confirmation, payment processing, fraud prevention, and Platform security.
They do not constitute endorsement or approval of the verified person.
9. Personal Safety and Property Condition
Property owners remain responsible for property condition, maintenance, code compliance, and legally required safety equipment.
Homes Away From Home does not continuously inspect listed properties.
To the maximum extent permitted by law, Homes Away From Home does not assume responsibility for independent third-party conduct or property conditions including:
- property defects;
- maintenance failures;
- fire;
- carbon monoxide;
- mold;
- pests;
- plumbing problems;
- electrical failures;
- theft;
- assault;
- harassment;
- criminal activity;
- weather conditions;
- neighborhood conditions;
- vehicle damage;
- lost or damaged personal property;
- pet-related incidents;
- acts or omissions of property owners, renters, guests, neighbors, contractors, or other third parties.
Nothing in this section excludes liability that applicable law prohibits Homes Away From Home from excluding.
10. Emergencies
Homes Away From Home is not an emergency-response service.
We do not continuously monitor properties, users, messages, or rental relationships for emergencies.
Users experiencing an immediate emergency should contact 911 or the appropriate local emergency service.
Payment & Payout Terms
11. Stripe Payment Processing
Homes Away From Home uses Stripe to process and facilitate eligible payments and payouts made through the Platform.
The Platform uses Stripe's separate-charges-and-transfers architecture. When a renter pays through the Platform, the renter's payment is processed through Homes Away From Home's Stripe account. The applicable net payout is later transferred to the property owner's connected Stripe account when the owner releases the payout from the dashboard.
Homes Away From Home may act as merchant of record for the payment-processing transaction, while the property owner remains the provider of the rental property and the party to the underlying rental relationship.
This payment role does not make Homes Away From Home the landlord, property manager, property owner, escrow agent, or party to the rental agreement.
Stripe payment functionality may include:
- payment authorization;
- payment processing;
- bank or card processing;
- connected accounts;
- payouts;
- refunds;
- payment reversals;
- ACH returns;
- card disputes;
- fraud screening;
- identity verification;
- banking settlement.
Homes Away From Home is not a bank, escrow company, trustee, or financial institution.
Stripe's terms, payment-network rules, bank rules, and applicable law may apply independently to payment activity.
12. Authorization to Process Payments
By initiating a payment through the Platform, the paying user authorizes the applicable payment processor to charge or debit the selected payment method for the amounts clearly disclosed before authorization.
Property owners authorize applicable Platform fees to be deducted, charged, or collected as disclosed for the transaction.
Payment authorization does not change the identity of the landlord or renter and does not make Homes Away From Home a party to the underlying lease.
13. Current Platform Fees
Unless a promotion or checkout disclosure states otherwise, current Platform charges are:
Property Listing
Standard annual listing subscription after applicable promotional eligibility:
$149.00 per listing per year
Rent Payments
ACH/bank rent payment:
3% Platform transaction fee, paid by the property owner
Credit/debit-card rent payment:
5% Platform transaction fee, paid by the property owner
Homes Away From Home does not currently charge renters a Platform service fee on the base rent payment itself.
Where a security deposit is collected together with the initial rent payment in a single transaction, the applicable Platform transaction fee is currently calculated on the combined payment amount, including the deposit.
Platform fees assessed in connection with a payment do not reduce or modify the property owner's legal responsibility for the full security-deposit amount stated in the applicable rental agreement. The property owner remains solely responsible for properly funding, holding, accounting for, administering, and returning the full security-deposit amount required by the rental agreement and applicable law.
Utility Payments
Utility-payment processing:
3% (bank/ACH) or 5% (card) processing fee, paid by the renter when applicable
Optional Features
30-day search boost:
$50.00 one-time
Priority inquiry:
$5.00 one-time
Fees displayed before a user authorizes a particular transaction control that transaction.
Homes Away From Home may change fees prospectively. Any changed fee will be disclosed before the user becomes obligated to pay it.
14. Price and Fee Transparency
Before a user authorizes payment, the Platform will disclose applicable amounts required for that transaction, which may include:
- rent;
- security deposit;
- property-owner fees;
- utility charges;
- applicable Platform or processing charges;
- taxes;
- amount due immediately;
- known future payment obligations;
- total amount being authorized.
Where applicable law requires mandatory charges to be included in an advertised or displayed total price before checkout, Homes Away From Home will present pricing in accordance with those requirements.
Taxes or government-imposed charges may be separately stated where permitted by applicable law.
15. Property Owner Payouts
Property owners receiving eligible payments through the Platform must complete applicable Stripe connected-account requirements.
Payouts are processed through Stripe's connected-account and banking infrastructure.
Banking and payout timing may depend on:
- Stripe;
- the payment method;
- the property owner's connected account;
- banking holidays;
- fraud or risk review;
- account verification;
- bank processing times;
- applicable payment-network requirements.
Homes Away From Home does not guarantee a specific bank-deposit time.
Refunds, ACH returns, payment disputes, and chargebacks may delay, reduce, block, or reverse an owner's payout.
If an owner payout has already been transferred, the applicable amount may be recovered or reversed through Stripe where necessary to reconcile a refund, payment dispute, chargeback, ACH return, or similar payment event.
A transfer reversal or recovery may result in a reduced connected-account balance, negative Stripe balance, or reduction of future payouts depending on Stripe's processes.
Property owners remain responsible for rental-related refunds, chargebacks, payment liabilities, and amounts attributable to their rental transactions to the extent provided by the rental agreement, these Terms, Stripe/payment-network rules, and applicable law.
16. First-Rent Payment Timing
When a renter pays through the Platform, the payment is processed by Stripe and the net amount (after the applicable Platform fee) is held pending payout in a "held" status.
Renter payments remain pending payout until the property owner initiates a Release Payout from the Homes Away From Home dashboard. When the owner releases a payout, the Platform creates a transfer of the net amount to the owner's connected Stripe account. After the transfer is created, Stripe controls the bank payout and timing according to Stripe's normal processing and payout schedule.
The Platform does not automatically release funds on a fixed schedule. The property owner controls when a held payout is released, subject to the owner's completed identity verification, the owner's connected Stripe account being ready to receive funds, and the absence of open disputes or chargebacks on the underlying payment.
If there is a disagreement about the property's condition or the rental, the property owner and renter are expected to resolve it directly between themselves, through their lease agreement, and under applicable landlord-tenant law. The Platform does not adjudicate ordinary landlord-renter disputes.
This is a payment-processing feature.
It is not:
- an escrow service;
- a security-deposit service;
- a property inspection;
- a guarantee that the property is satisfactory;
- a guarantee that the renter moved in;
- an adjudication process;
- a determination of either party's legal rights.
Actual payment availability and payout timing remain subject to Stripe, financial institutions, payment-network rules, fraud controls, and applicable law.
17. Security Deposits
Security deposits are established and administered by the property owner, not Homes Away From Home.
Property owners are solely responsible for determining, subject to applicable law:
- whether a security deposit is required;
- the amount;
- legally required disclosures;
- permitted collection methods;
- legally required storage or account requirements;
- inspections;
- documentation;
- damage claims;
- legally permissible deductions;
- itemized statements;
- required notices;
- return deadlines.
If technology available through the Platform is used to transmit or record a security-deposit payment, that functionality does not make Homes Away From Home the landlord, custodian, trustee, escrow agent, or administrator of the security deposit.
Homes Away From Home does not determine whether a claimed deduction is lawful or whether a property owner or renter is legally entitled to disputed security-deposit funds.
The property owner remains responsible for complying with the security-deposit laws applicable to the property.
18. Utility Charges
Property owners are responsible for ensuring that utility amounts charged to renters are:
- accurate;
- properly documented where required;
- legally permissible;
- allocated lawfully;
- consistent with the rental agreement;
- properly disclosed.
The Platform may provide technology allowing a property owner to submit an eligible utility charge and a renter to pay it.
Homes Away From Home does not independently certify that each utility charge is legally valid.
19. Rental Refunds
Rental refunds are governed by:
- the applicable property owner's disclosed cancellation or refund policy;
- the rental agreement between owner and renter; and
- applicable law.
Where supported, a property owner may initiate an eligible refund using payment functionality made available through the Platform.
Stripe processes applicable payment refunds.
If an owner payout has already been transferred, the Platform may recover or reverse the owner's proportional share of the refunded amount through Stripe transfer reversal, subject to Stripe's processes and the amounts available on the owner's connected account.
Homes Away From Home handles the payment-processing mechanics but does not adjudicate ordinary landlord-renter disagreements or determine the parties' legal liability under the rental agreement.
Homes Away From Home does not independently determine which party is legally entitled to a refund arising from an ordinary landlord-renter disagreement.
Homes Away From Home or Stripe may nevertheless reverse, refund, restrict, or otherwise act on a transaction when required by applicable law, payment-network rules, fraud-prevention requirements, processor requirements, court order, or other legal process.
20. Payment Disputes and Chargebacks
Payment-method disputes, card chargebacks, ACH returns, unauthorized-payment claims, and similar payment-network matters are handled through Stripe, the applicable financial institutions, and applicable payment-network procedures.
The financial responsibility for a particular payment dispute depends on the applicable Stripe account and transaction structure.
A chargeback, dispute, or ACH return may delay, reduce, block, or reverse an owner's payout. If an owner payout has already been transferred, the applicable amount may be recovered or reversed through Stripe where necessary to reconcile the dispute or return.
Homes Away From Home handles the payment-processing mechanics but does not adjudicate ordinary landlord-renter disagreements or determine the parties' legal liability under the rental agreement.
Nothing in these Terms prohibits a user from exercising a lawful, good-faith right to dispute an unauthorized or improper payment.
Fraudulent chargebacks, knowingly false payment disputes, or misuse of payment-dispute procedures may violate these Terms.
21. Rental Disputes Are Between Owner and Renter
A disagreement about:
- property condition;
- damage;
- security deposits;
- cancellation;
- rent;
- utilities;
- lease obligations;
- occupancy;
- property rules;
- landlord performance;
- renter performance
is ordinarily a dispute between the property owner and renter.
Homes Away From Home does not act as a judge, arbitrator, landlord, property manager, or legal decision-maker for those disputes.
Homes Away From Home may:
- provide technical support;
- preserve or review Platform records;
- allow users to communicate;
- enforce Platform rules;
- investigate suspected fraud or abuse;
- restrict Platform accounts for violations of these Terms.
Those actions do not make Homes Away From Home a party to the rental agreement.
Cancellation & Refund Policy
22. Rental Cancellations
Property owners are responsible for clearly disclosing applicable cancellation terms before a renter becomes obligated to the rental, subject to applicable law.
The applicable rental agreement may provide additional cancellation rights or obligations.
A cancellation submitted through Platform technology does not itself determine the parties' legal rights.
Refund eligibility remains subject to the owner's applicable policy, the rental agreement, payment-network requirements, and applicable law.
23. Rent Refunds
Where a rent refund is authorized by the property owner or otherwise required, the eligible refund may be processed through Stripe.
Refund arrival times vary by payment method, bank, and payment processor.
Homes Away From Home does not guarantee the date on which a bank or card issuer will post a refund.
24. Security-Deposit Returns
Property owners are solely responsible for administering security-deposit deductions and returns in compliance with applicable law.
Any Platform function allowing an owner to document or transmit a deposit-related action is a technology tool only.
Use of that tool does not constitute Homes Away From Home approval of:
- alleged property damage;
- a deduction;
- an itemization;
- a withholding decision;
- the legality of a deposit refund.
25. Utility-Payment Refunds
Utility-payment refunds are subject to:
- whether payment has already been transmitted;
- the applicable rental agreement;
- the property owner's obligations;
- Stripe's processing requirements;
- applicable law.
Homes Away From Home does not independently determine the legal validity of the underlying utility charge.
26. Optional Feature Refunds
The $50 30-day search boost and $5 priority inquiry are one-time purchases and are non-refundable after the applicable feature is activated, except where required by law or where the purchased service is not provided.
Priority Inquiry — $5 one-time
Priority Inquiry is an optional Platform feature that places or highlights the renter's inquiry at or near the top of the applicable property owner's inquiry list.
Renters may submit a normal inquiry without purchasing Priority Inquiry.
Purchasing Priority Inquiry does not guarantee:
- that the property owner will view the inquiry;
- a response;
- rental approval;
- acceptance of a booking request;
- entry into a lease or rental agreement;
- preferential treatment by the property owner.
Property owners remain independently responsible for rental decisions and must comply with applicable Fair Housing and nondiscrimination laws.
30-Day Search Boost — $50 one-time
Buying a search boost does not guarantee:
- inquiries;
- bookings;
- occupancy;
- revenue;
- search impressions;
- a particular ranking beyond the specifically described feature;
- return on investment.
26A. Early Termination of Bookings
The Platform may allow a property owner or administrator to end a booking before its originally scheduled end date.
Ending a booking early stops any future scheduled rent charges and frees the property's availability calendar for dates after the early end date.
Any payment already collected before the early end date remains subject to the property owner's refund and cancellation terms and applicable law. The Platform does not automatically refund amounts for rental periods after an early termination.
Listing Subscription & Launch Promotion
27. Standard Listing Subscription
After the Launch Promotion described below has been filled or where a listing does not qualify for that promotion, the standard listing subscription is:
$149.00 per property listing per year.
Unless otherwise disclosed during signup, a paid listing subscription automatically renews annually until cancelled.
Before a user enrolls in a recurring paid subscription, Homes Away From Home will clearly disclose:
- subscription price;
- billing frequency;
- automatic-renewal terms;
- cancellation method;
- material promotional terms.
The user must affirmatively authorize the recurring charge.
28. Subscription Renewal
Paid annual listing subscriptions renew on the applicable annual renewal date unless cancelled before renewal.
Homes Away From Home will provide an advance renewal reminder where required by applicable law and currently intends to provide an email reminder approximately 30 days before annual renewal.
A cancellation submitted before the next renewal prevents the next renewal charge.
Cancellation does not automatically create a refund for a previously paid subscription period except where required by law or expressly stated otherwise.
29. Cancelling a Paid Listing Subscription
Property owners may cancel a paid listing subscription through their host dashboard.
Cancellation must not require the property owner to call or use a materially more burdensome method than the method used to subscribe.
After cancellation:
- the listing remains active through the end of the already-paid subscription period unless otherwise requested;
- no new annual subscription charge will be made for the cancelled listing;
- the listing may move to draft or inactive status when the paid period ends.
30. First 100 Listings — Launch Promotion
Homes Away From Home's current launch promotion provides:
The first 100 qualifying property listings receive a $0 listing/subscription fee for the life of the qualifying promotional listing.
This promotion applies to the listing/subscription fee only.
It does not waive:
- rent transaction fees;
- payment-processing charges;
- utility-payment charges;
- search boosts;
- priority inquiries;
- taxes;
- property-owner charges;
- other optional paid features.
A promotional listing remains subject to all Platform Terms and policies.
31. Launch Promotion Eligibility
A property listing qualifies for one of the first 100 promotional positions when:
- promotional positions remain available;
- the listing represents a genuine property;
- the person publishing it has lawful authority to rent the property;
- required listing information has been completed;
- applicable account requirements have been completed;
- the listing is successfully published.
Draft listings do not reserve promotional positions.
Homes Away From Home may reject or remove:
- duplicate listings created to obtain multiple promotional positions;
- fraudulent listings;
- fictitious properties;
- spam listings;
- unauthorized listings;
- listings created primarily to manipulate promotional eligibility.
A qualifying promotional listing has no cash value.
The promotional benefit may not be separately sold, assigned, or transferred.
If a qualifying property is deleted and later recreated, promotional eligibility is not automatically restored.
A change in property ownership or transfer of the user account does not automatically transfer the promotional benefit.
Homes Away From Home will honor earned promotional benefits for qualifying listings that remain in good standing under these Terms.
31A. First Paid Listing 50% Off (First Year)
A property owner's first paid listing subscription is 50% off for the first year ($74.50 instead of $149.00). The full annual rate applies beginning with the first renewal.
This benefit is tracked by a permanent PricingAward record and is not affected by subsequent listing creation or deletion. A promotional listing that was free under the First 100 Listings promotion does not consume this first-paid-listing discount.
31B. Every Fifth Listing Free
A property owner's 5th, 10th, 15th, and subsequent every-fifth paid listing subscription is free for the life of the qualifying listing.
Eligibility is determined by the owner's total count of PricingAward records at checkout-session creation time. The promotional slot is permanently consumed only when checkout completes; an abandoned or failed checkout does not consume a position.
If a qualifying listing is deleted and later recreated, the free-listing benefit is not automatically restored. A change in property ownership or user account does not automatically transfer the benefit.

31C. Retention Discount During Cancellation
Homes Away From Home may, at its discretion, offer a property owner a discounted renewal rate as a retention incentive when the owner initiates a subscription cancellation.
If accepted, the discount applies to the next annual renewal only and does not change the standard subscription price for subsequent renewals.
31D. Custom Portfolio Pricing
Homes Away From Home may offer customized pricing for property owners with more than 15 listings.
Custom pricing is provided on a case-by-case basis and will be disclosed in writing before the owner enrolls. Custom pricing terms, once agreed, apply in lieu of the standard subscription rate for the qualifying listings.
31E. Promotional Codes
Homes Away From Home may, at its discretion, issue promotional codes that waive or reduce the listing subscription fee. Promotional codes may apply to the first year only or to all renewal periods.
Promotional code terms will be disclosed at the time the code is issued. Promotional codes have no cash value and may not be transferred. Homes Away From Home may modify or discontinue promotional codes at any time.
Fair Housing & Nondiscrimination Policy

Homes Away From Home supports Equal Housing Opportunity.
Users must comply with all applicable federal, state, and local Fair Housing and nondiscrimination laws.

Homes Away From Home may use descriptive categories such as:
- healthcare professionals;
- travel professionals;
- students;
- interns;
- contractors;

- relocating employees;
- military or government travelers;
- other term-housing users.
These categories are intended to help describe common uses for a property or Platform.
They must not be used to unlawfully exclude otherwise eligible renters on the basis of a legally protected characteristic.
Homes Away From Home may provide an Everyone, Anyone, or equivalent general-audience option.
35. Assistance Animals and Reasonable Accommodations
Assistance animals are not treated the same as ordinary pets when applicable housing law provides accommodation rights.
A property's ordinary "no pets" rule does not eliminate a person's rights under applicable disability and Fair Housing law.
Property owners must consider legally valid reasonable-accommodation requests, including applicable requests concerning service or assistance animals.
Where applicable law prohibits doing so, an owner may not impose an ordinary pet fee, pet deposit, or pet rule on a qualifying assistance animal.
Property owners remain responsible for determining and complying with applicable accommodation requirements.

37. Reviews
Reviews are user-generated opinions and do not necessarily reflect the views of Homes Away From Home.
Users may not submit:
- fake reviews;
- reviews falsely claiming an experience that did not occur;
- reviews created through impersonation;
- reviews generated through coordinated manipulation;
- threats designed to improperly suppress legitimate reviews;
- unlawful discriminatory content;
- harassment;
- confidential information;
- infringing content;
- content otherwise prohibited by these Terms.
Homes Away From Home will not require a review to be positive or negative as a condition of an incentive.
If an incentive for a review is ever offered, it must not be conditioned on a particular sentiment, and legally required disclosures must be made.
Homes Away From Home may moderate reviews for violations of Platform rules but will not remove a legitimate review merely because it is negative.
Nothing in these Terms prohibits a user from expressing an honest opinion or making a lawful statement about their experience.
38. User-Generated Content

Users retain ownership of their original content.
By submitting content to the Platform, the user grants Homes Away From Home a nonexclusive, worldwide, royalty-free license to host, store, reproduce, format, resize, display, transmit, distribute, and use that content as reasonably necessary to:
- operate the Platform;
- display the user's listing or profile;
- provide Platform functionality;
- communicate with users;
- promote the user's listing;
- promote Homes Away From Home;
- maintain legally or operationally necessary records.
This license ends when the content is deleted or the account is closed except for copies reasonably retained in backups, transaction records, legal records, or materials already lawfully distributed, and except where continued retention is otherwise permitted or required by law.
Users represent that they have all rights necessary to submit their content.

42. Account Suspension and Removal
Homes Away From Home may suspend, restrict, remove, or terminate an account or listing when reasonably appropriate because of:

- booking volume;

- protection against fraud.
Platform Availability
65. Service Interruptions
Homes Away From Home does not guarantee uninterrupted access to the Platform.
Service may be interrupted because of:
- internet outages;
- hosting outages;
- software failures;
- payment-processor outages;
- bank outages;
- cyberattacks;
- maintenance;
- natural disasters;
- government action;
- utility failures;
- other events beyond reasonable control.
We may modify, suspend, or discontinue features subject to applicable contractual and legal obligations.

THIS SECTION DOES NOT DISCLAIM WARRANTIES OR CONSUMER RIGHTS THAT CANNOT LAWFULLY BE DISCLAIMED.
67. Third-Party and User Conduct
Homes Away From Home is not responsible for the independent conduct of users merely because they use the Platform.
To the maximum extent permitted by applicable law, claims arising from a property owner's or renter's independent:
- property condition;
- lease obligations;
- misrepresentations;
- security-deposit decisions;
- utilities;
- personal conduct;
- negligence;
- off-platform transactions;
- property damage;
- injury;
- other rental activity
remain the responsibility of the applicable party.
Nothing in these Terms releases Homes Away From Home from liability that cannot lawfully be released.
68. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HOMES AWAY FROM HOME AND THOMAS HOUSING LLC WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATING TO THE PLATFORM, INCLUDING LOST PROFITS, LOST REVENUE, LOST OPPORTUNITY, LOSS OF GOODWILL, BUSINESS INTERRUPTION, LOSS OF DATA, OR SUBSTITUTE HOUSING COSTS, EXCEPT WHERE SUCH LIMITATION IS PROHIBITED BY LAW.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE AGGREGATE LIABILITY OF HOMES AWAY FROM HOME AND THOMAS HOUSING LLC ARISING FROM OR RELATING TO THE PLATFORM WILL NOT EXCEED THE GREATER OF:
A. THE PLATFORM FEES ACTUALLY PAID BY THE CLAIMING USER TO HOMES AWAY FROM HOME DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM; OR
B. $100.00.
THESE LIMITATIONS DO NOT APPLY TO LIABILITY THAT APPLICABLE LAW PROHIBITS US FROM LIMITING OR EXCLUDING.
69. Indemnification
To the maximum extent permitted by applicable law, a user agrees to defend, indemnify, and hold harmless Homes Away From Home, Thomas Housing LLC, and their owners, members, officers, employees, contractors, affiliates, and agents from third-party claims, liabilities, losses, penalties, damages, and reasonable legal costs arising from or relating to:
- the user's property;
- the user's listing;
- the user's rental relationship;
- the user's conduct;
- the user's breach of these Terms;
- the user's violation of law;
- housing-code violations;
- Fair Housing violations;
- security-deposit violations;
- tax obligations;
- property injury claims;
- intellectual-property infringement;
- user-generated content;
- fraud or misrepresentation by the user.
This provision applies only to the extent enforceable under applicable law and does not require a user to indemnify Homes Away From Home for liability caused solely by Homes Away From Home where applicable law prohibits such indemnification.
70. Age and Authority
Users must be at least 18 years old and legally capable of entering into binding agreements.
A person acting for a company, LLC, partnership, trust, property owner, or other organization represents that the person has authority to act for that entity.
71. Electronic Agreements and Communications
Users agree that electronic:

Homes Away From Home may update these Terms and incorporated policies as the Platform evolves.
The effective date will be updated when changes are made.
Material changes will receive notice where required by law or where appropriate based on the nature of the change.
Where renewed consent is legally required, Homes Away From Home will obtain it.
Changes will not retroactively eliminate rights that applicable law prohibits us from eliminating.
73. Governing Law
Except to the extent a different law must apply because of a legally non-waivable right, these Terms and the user's contractual relationship with Homes Away From Home are governed by the laws of the State of Montana, without regard to conflict-of-law rules.
This provision does not replace the landlord-tenant law applicable to the property.
The law governing an owner's and renter's lease may depend on the jurisdiction in which the property is located.
74. Venue
To the extent permitted by applicable law, disputes directly between a user and Homes Away From Home or Thomas Housing LLC relating to these Terms or the Platform will be brought in an appropriate state or federal court located in Montana.
This provision does not prevent a user from exercising a legally non-waivable right to bring a claim in another forum.
75. No Mandatory Arbitration
These Terms do not currently require mandatory arbitration.
These Terms do not currently impose a contractual class-action waiver.
76. Severability
If any provision of these Terms is held invalid or unenforceable, it will be enforced to the maximum extent legally permissible or severed as appropriate.
The remaining provisions will continue in effect unless applicable law requires otherwise.
77. No Waiver
Failure to enforce a provision on one occasion does not automatically waive the right to enforce that provision later.
78. Assignment
Users may not assign their Platform account or these Terms in a manner that violates Platform rules or applicable law.
Homes Away From Home may assign applicable contractual rights and obligations in connection with:
- merger;
- acquisition;
- financing;
- corporate reorganization;
- sale of the business;
- sale of substantially all applicable assets,
subject to applicable law.
79. Survival
Provisions that logically should continue after termination remain in effect, including applicable provisions concerning:
- payment obligations;
- intellectual property;
- privacy and retained records;
- limitations of liability;
- indemnification;
- governing law;
- disputes;
- other accrued rights.
80. Entire Agreement
These Terms and policies incorporated into them constitute the agreement between the user and Homes Away From Home concerning use of the Platform.
A lease or rental agreement between a property owner and renter is a separate agreement.

81. Customer Support
Homes Away From Home provides Platform-related customer support.
We aim to respond to ordinary support requests within approximately 24–48 hours, but response times are not guaranteed and may vary.
Customer support does not constitute:
- emergency services;
- legal representation;
- property management;
- landlord representation;
- renter representation;
- adjudication of private rental disputes.
