Platform standard lease · v2026-08

Platform Standard Residential Rental Agreement

This is the platform's standard lease. Hosts who select "Use the platform's standard lease" on their listing are bound by these terms, and renters agree to them at checkout. At checkout, the Booking Summary (property address, rent, dates, deposit, occupants, utilities, and property rules) is filled in from the accepted booking and incorporated into this Agreement.

Not legal advice. This is a general platform template, not a substitute for jurisdiction-specific legal counsel. Mandatory federal, state, and local law controls over any conflicting provision. Security deposits, late fees, entry notice, termination, eviction, abandonment, habitability, and required disclosures vary by jurisdiction. Hosts and renters are encouraged to consult a landlord-tenant attorney for local requirements.

HOMES AWAY FROM HOME

STANDARD RESIDENTIAL RENTAL AGREEMENT

Agreement Version:

Date Accepted:

Booking ID:

This Standard Residential Rental Agreement ("Agreement") is entered into between the property owner or legally authorized representative identified below ("Owner") and the renter identified below ("Renter").

Homes Away From Home, operated by Thomas Housing LLC ("Platform"), provides marketplace and technology services. Homes Away From Home is not a party to this rental Agreement and is not the landlord, tenant, property manager, real-estate broker, leasing agent, escrow agent, trustee, or guarantor of either party.

This Agreement is a general residential rental template. Federal, state, and local laws applicable to the location of the Premises may provide additional rights or requirements. Mandatory applicable law controls over any conflicting provision of this Agreement.

2. PREMISES

ZIP:

Rental Type:

The rental includes the furnishings, appliances, parking, storage areas, amenities, and other items specifically identified in the accepted listing, Booking Summary, or property terms.

No garage, storage area, parking space, amenity, or other portion of the property is included unless identified as part of the rental.

3. RENTAL TERM

Start Date:

Move-In Time:

End Date:

Move-Out Time:

This is a fixed-term tenancy unless otherwise stated.

The Agreement does not automatically renew unless Owner and Renter agree to a renewal or extension in writing or applicable law provides otherwise.

Any extension or material change to the rental term must be agreed to in writing, including through an authorized Platform process.

If Renter remains in possession after the term expires without an approved extension, the parties' rights and obligations will be governed by applicable law.

4. RENT

Rent Amount: $

Payment Frequency:

First Payment Due:

Regular Payment Due:

Renter agrees to timely pay all rent lawfully due under this Agreement.

Where rent is paid through Homes Away From Home, eligible payments are processed through the Platform's designated third-party payment provider, currently Stripe, and are subject to applicable Platform Payment Terms.

Renter remains responsible for amounts lawfully owed if a payment is declined, returned, reversed, or otherwise unsuccessful.

5. SECURITY DEPOSIT

Security Deposit: $

The security deposit is established and administered by Owner.

Owner is responsible for complying with all applicable laws governing:

security-deposit limits;
collection;
receipts;
required storage or account treatment;
interest, where required;
inspections;
damage documentation;
legally permissible deductions;
itemized statements;
notices; and
return deadlines.

A security deposit may be used only for purposes permitted by applicable law.

Permitted deductions may include, where legally allowed:

unpaid rent or other lawful amounts;
damage beyond ordinary wear and tear;
missing property;
legally recoverable cleaning costs; or
other deductions permitted by applicable law.

The security deposit is not automatically forfeited because Renter cancels, terminates early, or breaches this Agreement.

Renter may not apply the security deposit toward the final rent payment unless Owner agrees in writing or applicable law permits it.

If Platform or Stripe payment technology is used to transmit or document a security-deposit payment, that does not make Homes Away From Home the holder, administrator, trustee, or escrow agent for the deposit.

Homes Away From Home does not determine whether a security-deposit deduction or refund is legally appropriate.

6. OTHER CHARGES

The following additional charges apply:

Late Fee

Late Fee:

Any late fee or returned-payment fee applies only if properly disclosed and permitted by applicable law.

No mandatory charge may be imposed where prohibited by law.

7. UTILITIES

Utilities Included in Rent

Utilities Paid Separately by Renter

Each party is responsible for the utilities assigned to that party under this Agreement.

If Owner separately bills Renter for utilities, the charges must be accurately calculated, properly disclosed, and legally permissible.

Utilities may not be intentionally terminated as an unlawful means of forcing Renter to leave the Premises.

8. CONDITION OF PREMISES

Owner shall deliver the Premises in the condition required by applicable law and substantially consistent with the accepted property listing.

Renter should inspect the Premises promptly after taking possession and document existing conditions using photographs, video, a written move-in inspection, Platform messaging, or another written method.

Renter is not responsible for properly documented pre-existing conditions or ordinary wear and tear.

Where applicable law requires a move-in condition report, inventory, inspection, or similar document, Owner is responsible for providing it.

9. HABITABILITY, MAINTENANCE, AND REPAIRS

Owner is responsible for maintaining the Premises as required by applicable landlord-tenant, housing, health, building, and safety laws.

Nothing in this Agreement waives any legally non-waivable right concerning:

habitability;
essential utilities;
required repairs;
heat;
water;
plumbing;
electrical service;
legally required smoke or carbon-monoxide alarms;
structural safety; or
other mandatory housing standards.

Renter shall promptly notify Owner of significant damage, leaks, unsafe conditions, or needed repairs.

Homes Away From Home is not responsible for maintaining or repairing the Premises.

10. RENTER'S CARE OF PREMISES

Renter agrees to:

keep the Premises reasonably clean and sanitary;
use appliances, fixtures, furniture, and plumbing reasonably;
dispose of garbage appropriately;
avoid intentional, reckless, or negligent damage;
promptly report significant leaks, damage, or safety hazards;
comply with applicable laws; and
comply with lawful property rules.

To the extent permitted by law, Renter may be responsible for damage caused by Renter, approved occupants, guests, or pets beyond ordinary wear and tear.

11. OCCUPANCY

Maximum Occupancy:

The Premises may be occupied as a residence only by Renter and the approved occupants identified in this Agreement unless Owner approves another occupant or applicable law provides otherwise.

Occupancy requirements must be applied consistently with applicable Fair Housing and other housing laws.

12. GUESTS

Guest Rules:

Guests are permitted subject to reasonable property rules and applicable law.

Renter is responsible for guest conduct to the extent permitted by law.

Guest restrictions may not be applied in a discriminatory manner or used to interfere with legally protected tenant rights.

13. ASSIGNMENT AND SUBLETTING

Renter may not assign this Agreement, sublease the Premises, or rent any portion of the Premises to another person without Owner's prior written permission, except where applicable law provides otherwise.

14. PETS AND ASSISTANCE ANIMALS

Pet Policy:

Approved Pets:

Pet Fee or Deposit:

Renter is responsible for pet-related damage to the extent permitted by law.

Legally protected service animals and assistance animals are not treated as ordinary pets where applicable law requires otherwise.

Nothing in this Agreement or a property "No Pets" policy limits rights concerning legally required reasonable accommodations.

15. SMOKING AND VAPING

Smoking/Vaping Policy:

Renter and guests shall comply with the smoking and vaping policy accepted as part of this Agreement.

Renter may be responsible for legally recoverable damage resulting from prohibited smoking or vaping.

16. PARKING

Parking:

Renter shall comply with any disclosed parking restrictions.

Owner does not insure Renter's vehicle or personal property except where applicable law otherwise requires.

17. KEYS AND ACCESS

Owner shall provide the keys, entry codes, cards, remotes, or other access devices reasonably necessary for occupancy.

Renter shall return Owner-provided access devices when the tenancy ends.

Where permitted by law, Renter may be responsible for reasonable replacement costs for lost access devices.

18. OWNER ACCESS AND ENTRY

Owner may enter the Premises for lawful purposes including:

repairs;
maintenance;
inspections;
agreed services;
showing the Premises when permitted;
emergencies; or
other purposes permitted by law.

Owner shall provide the notice required by applicable law and enter at lawful and reasonable times except where an emergency or other lawful exception applies.

Platform messaging may be used to document an entry notice.

If applicable law requires a particular notice period or delivery method, the legally required procedure controls.

19. ALTERATIONS

Renter may not materially alter, remodel, paint, install permanent fixtures, or make significant modifications to the Premises without Owner's written permission except where applicable law provides otherwise.

Nothing in this section limits legally protected accessibility modifications or reasonable accommodations.

20. HOUSE RULES

The property rules accepted at the time this Agreement is formed are incorporated into this Agreement.

House Rules Version:

House rules must be lawful and may not:

violate Fair Housing requirements;
conflict with mandatory tenant protections; or
be materially changed during the tenancy without the parties' agreement unless applicable law permits the change.

Changes to the public listing after this Agreement is executed do not change the house rules already accepted by Renter.

21. RENTER'S INSURANCE AND PERSONAL PROPERTY

Renter is responsible for Renter's personal belongings except where applicable law imposes responsibility on Owner.

Owner's property insurance generally does not insure Renter's personal property.

Renter is encouraged to obtain renter's insurance.

If Owner requires renter's insurance, the requirement must be disclosed before this Agreement is formed and must comply with applicable law.

Nothing in this provision releases either party from liability imposed by law.

22. DAMAGE, FIRE, CASUALTY, OR UNINHABITABLE CONDITIONS

If fire, flooding, natural disaster, structural failure, or another casualty materially damages the Premises, Owner and Renter shall promptly notify each other.

Rights regarding:

repairs;
rent reduction;
temporary relocation;
termination;
possession;
prepaid rent; and
refunds

are determined by applicable law and this Agreement to the extent enforceable.

Nothing in this Agreement requires Renter to remain in housing where applicable law provides a right to terminate because of unsafe or uninhabitable conditions.

23. PROPERTY UNAVAILABLE AT MOVE-IN

Owner represents that Owner has lawful authority to rent the Premises and intends to provide possession as agreed.

If Owner cannot provide possession on the agreed move-in date or the Premises materially differ from what was agreed in a manner that affects the rental, Owner and Renter shall address the applicable remedy under:

this Agreement;
the applicable cancellation terms; and
applicable law.

Homes Away From Home does not adjudicate the underlying landlord-renter dispute.

Any payment refund, reversal, chargeback, risk hold, or similar payment action processed through Stripe remains subject to applicable payment-processing procedures and law.

24. CANCELLATION BEFORE MOVE-IN

Cancellation Policy:

Cancellation before Renter takes possession is governed by:

the cancellation terms accepted before this Agreement was formed;
this Agreement;
applicable law; and
applicable Platform Payment and Cancellation Terms where Platform payment technology is used.

No cancellation policy authorizes a security-deposit deduction or other withholding prohibited by applicable law.

25. EARLY TERMINATION AFTER MOVE-IN

After Renter takes possession, early termination rights are governed by this Agreement and applicable law.

If Renter leaves before the end of the term without a contractual or legal right to terminate, Renter may remain responsible for legally recoverable losses.

Owner must comply with any applicable duty to mitigate damages, including reasonable efforts to re-rent the Premises where legally required.

Owner may not recover duplicate rent for the same period beyond amounts permitted by law.

Nothing in this Agreement limits legally protected termination rights, including rights arising from:

uninhabitable conditions;
casualty;
domestic violence or similar legally protected circumstances;
unlawful Owner conduct;
qualifying military service; or
other rights provided by applicable law.

26. DEFAULT AND TERMINATION

A party may be in default if that party materially fails to perform an obligation under this Agreement.

Any:

notice of nonpayment;
notice of breach;
opportunity to cure;
termination notice;
demand for possession; or
eviction proceeding

must comply with applicable law.

A Platform cancellation, account restriction, or account termination does not itself authorize Owner to physically remove Renter from the Premises.

27. NO UNLAWFUL SELF-HELP EVICTION

Owner may not use unlawful methods to recover possession, including unlawful:

lockouts;
utility shutoffs;
removal of Renter's property;
physical removal;
harassment; or
threats.

Owner must use the procedures required by applicable law.

28. ABANDONED PROPERTY

Property left behind by Renter shall be handled according to applicable state and local law.

Owner shall comply with any legally required notice, storage, waiting-period, disposal, sale, or accounting requirements.

29. FAIR HOUSING AND NONDISCRIMINATION

Owner and Renter shall comply with applicable federal, state, and local Fair Housing and nondiscrimination laws.

Federal Fair Housing law generally prohibits housing discrimination because of:

race;
color;
national origin;
religion;
sex;
familial status; and
disability.

State or local law may protect additional characteristics.

Nothing in this Agreement permits unlawful discrimination.

30. REQUIRED DISCLOSURES AND ADDENDA

Owner is responsible for providing any disclosures or addenda required by federal, state, or local law for the Premises.

Depending on the property and location, required disclosures may concern matters including:

lead-based paint;
mold;
radon;
flooding;
bed bugs;
smoke or carbon-monoxide alarms;
utility allocation;
security deposits;
move-in conditions;
landlord or authorized-agent information;
rent control;
tenant rights; or
other legally required subjects.

Any required disclosure or addendum delivered and accepted as part of the rental is incorporated into this Agreement.

Lead-Based Paint Where federal lead-based-paint disclosure requirements apply, Owner is responsible for providing all required disclosures, records, warning statements, and required informational materials before Renter becomes legally bound.

31. MILITARY PROTECTIONS

Nothing in this Agreement limits any right provided by the federal Servicemembers Civil Relief Act or other applicable military-protection laws.

Qualifying servicemembers may have statutory rights to terminate residential leases under circumstances established by applicable law.

32. OWNER REPRESENTATIONS

Owner represents that:

Owner owns the Premises or is legally authorized to rent it;
the property information supplied by Owner is materially accurate to Owner's knowledge;
Owner has obtained required permission to offer the rental;
Owner will comply with applicable landlord-tenant and housing laws;
Owner will comply with applicable Fair Housing requirements;
Owner will comply with applicable licensing and registration requirements;
Owner will comply with applicable tax requirements;
Owner will comply with security-deposit laws;
Owner will comply with applicable habitability and safety requirements; and
Owner is responsible for determining whether the rental term offered is lawful where the property is located.

Homes Away From Home's publication of a property does not constitute a legal determination that the rental complies with every applicable law.

33. RENTER REPRESENTATIONS

Renter represents that:

information supplied in connection with the rental is materially accurate;
Renter is legally capable of entering this Agreement;
Renter intends to use the Premises primarily for lawful residential purposes; and
Renter will comply with this Agreement and lawful property rules.

34. HOMES AWAY FROM HOME'S ROLE

Owner and Renter acknowledge that Homes Away From Home operates a technology marketplace connecting independent property owners and renters.

Homes Away From Home is not a party to this Agreement.

Unless separately agreed in writing, Homes Away From Home does not:

own the Premises;
act as landlord;
act as tenant;
manage the property;
maintain the property;
act as real-estate broker or leasing agent;
determine property habitability;
administer Owner's security deposit;
determine property damage;
determine lawful security-deposit deductions;
decide eviction rights;
adjudicate private rental disputes;
guarantee Owner's performance;
guarantee Renter's performance; or
guarantee the accuracy of every property listing.

Homes Away From Home's separate Terms of Service, Privacy Policy, Payment Terms, and other Platform policies govern each user's relationship with the Platform.

35. PAYMENT PROCESSING

Where payments are made through Platform technology, eligible payments are processed using third-party payment infrastructure, currently including Stripe.

Payment-processing functions may include:

payment authorization;
card processing;
bank/ACH processing;
connected accounts;
payouts;
refunds;
reversals;
chargebacks; and
fraud or risk controls.

Homes Away From Home does not operate an escrow service.

Payment processing does not change Owner's legal obligations as housing provider or Renter's rights under applicable landlord-tenant law.

Ordinary disputes concerning the rental relationship remain between Owner and Renter.

36. NOTICES

Routine communications may be delivered through Platform messaging, email, or another method agreed by the parties.

If applicable law requires a specific:

form;
method of delivery;
mailing address;
notice period;
content; or
service procedure,

the legally required procedure controls.

Platform messaging does not replace legally required formal service unless permitted by applicable law.

37. ELECTRONIC AGREEMENT

Owner and Renter consent to entering this Agreement electronically to the extent permitted by applicable law.

Each party's affirmative electronic acceptance constitutes that party's electronic signature where legally effective.

The final rental record should include:

this Agreement;
the Booking Summary;
accepted house rules;
required disclosures and addenda;
Agreement version;
booking identifier; and
acceptance date and time for each party.

Both parties should receive or retain access to a downloadable or otherwise reproducible copy of the executed Agreement.

38. CHANGES TO AGREEMENT

No material modification to this Agreement is binding unless:

Owner and Renter agree to the modification in writing; or
applicable law permits the modification without mutual agreement.

Editing the public property listing after execution does not change this Agreement.

39. SEVERABILITY AND MANDATORY LAW

If a provision of this Agreement is prohibited or unenforceable under applicable law, it will be interpreted to the maximum lawful extent or severed as appropriate.

The remaining Agreement will remain effective unless applicable law requires otherwise.

Whenever this Agreement conflicts with a legally non-waivable federal, state, or local requirement, the mandatory law controls.

40. GOVERNING LAW

The rental relationship and this Agreement are governed by the laws applicable to the location of the Premises.

Nothing in this Agreement deprives either party of a legally non-waivable right or remedy.

41. ENTIRE RENTAL AGREEMENT

The complete rental agreement between Owner and Renter consists of:

this Standard Residential Rental Agreement;
the Booking Summary;
the accepted property-specific house rules;
any accepted property-specific terms;
the applicable cancellation policy;
required federal disclosures;
required state or local disclosures/addenda; and
any later written modification accepted by both parties.

Homes Away From Home's Platform Terms and policies separately govern each user's relationship with Homes Away From Home.

Platform Standard Lease Notice The Homes Away From Home Standard Residential Rental Agreement is an optional general rental template provided for convenience.

Property owners remain responsible for ensuring that their rental complies with federal, state, and local law and for providing any legally required property-specific disclosures or addenda.

Mandatory applicable law controls over any conflicting provision.

This standard lease is provided by Homes Away From Home as a default template. Hosts who prefer their own lease may upload it to their listing instead. Renters should always review the applicable lease before completing checkout. At checkout, the Booking Summary is filled in from the accepted booking and the listing/house rules are frozen at that point — later edits to the public listing do not change an existing agreement.
